Terms of Service
Effective date: October 31, 2026 Last updated: October 31, 2026
These Terms of Service ("Terms") are an agreement between you and Brandful, Inc. ("Brandful," "we," "us"). They cover your use of our website at bebrandful.com, our app at beta.bebrandful.com and any related services (together, the "Services"). By creating an account, requesting a brand snapshot or using the Services, you agree to these Terms. If you're using the Services on behalf of a business, you agree on behalf of that business, and "you" means the business.
Please also read our Privacy Policy, which explains how we handle personal information.
1. Who can use Brandful
The Services are for businesses and professionals. You must be at least 18 years old and able to form a binding contract. You're responsible for the accuracy of the information you give us and for keeping your login details secure. Tell us right away at privacy@bebrandful.com if you think your account has been accessed without permission.
2. What the Services do
Brandful analyzes your business, your website and the competitors you name, and uses that analysis, including artificial intelligence, to create a brand strategy, marketing plan, action items, scores, insights and related content (together, "Outputs"). Features may change as we improve the product.
Weekly brand email. Your subscription includes a weekly email with your scores, next steps, competitor activity and goal progress. It's part of the Services, not a marketing email, so it's sent for as long as your account is active. You can stop it by canceling your subscription or deleting your account. You can unsubscribe from marketing emails separately at any time.
3. Beta services
Brandful is currently in beta. Beta features may be incomplete, change or be removed, and may not always be available. We'll try to give notice of significant changes, but beta features are provided as is.
4. Subscriptions, billing and cancellation
- Free brand snapshot. You can start with a free brand snapshot. Free features may be limited and can change.
- Paid plans. Paid plans are billed in advance on a recurring monthly basis through our payment processor, Stripe, at the price shown when you subscribe. Your subscription renews automatically each month until you cancel.
- Introductory pricing. Our current price of $49 per month is introductory pricing offered during the beta. It is not a permanent or locked-in rate, and we expect to increase it as we add features and leave beta. Any increase follows the notice rules under "Price changes" below.
- Cancel anytime. You can cancel at any time from your account settings or by emailing us. Your access continues until the end of the billing period you've already paid for, and you won't be charged again.
- No refunds. Payments are non-refundable, and we don't provide refunds or credits for partial months or unused features, except where the law requires it.
- Price changes. We may change our prices, including when introductory pricing ends. We'll give you at least 30 days' notice by email before a price change applies to your subscription. If you don't cancel before the change takes effect, your subscription continues at the new price.
- Taxes. Prices don't include taxes unless we say so. You're responsible for any applicable taxes.
- Failed payments. If a payment fails, we may suspend paid features until it's resolved.
5. Your content and data
- You own your content. You keep all rights to the information and materials you provide to the Services, such as your business details, goals and edits ("Your Content").
- Permission to use it. You give Brandful a limited, non-exclusive, worldwide license to host, copy, process and use Your Content only to provide, maintain, secure and improve the Services for you. This license ends when Your Content is deleted from the Services, except for copies kept in routine backups or as required by law.
- Your responsibility. You confirm you have the rights to the content you provide, and that providing it doesn't violate any law or anyone else's rights.
6. Outputs
- You own your Outputs. As between you and Brandful, you own the Outputs created for your business, and you may use them for any lawful purpose, including in your marketing.
- Review before you rely on them. Outputs are generated with AI and may be inaccurate, incomplete, or similar to content created for others. They are suggestions, not professional legal, financial or other advice. You're responsible for reviewing Outputs and for how you use them, including making sure any claims you publish are true and that you have the rights to any names, images or materials you use.
- No guaranteed results. We don't guarantee any particular marketing, sales or business results.
7. Brandful's property
The Services, including our software, design, methods, prompts, scoring models (including the Brand Strength Score and Momentum Score), templates and content we provide, belong to Brandful and its licensors and are protected by intellectual property laws. Except for the rights we give you in these Terms, we keep all rights. If you send us feedback or ideas, we may use them without any obligation to you.
8. Acceptable use
You agree not to:
- Use the Services for anything illegal, deceptive or harmful, or to create misleading claims about your business or others
- Use the Services to harass, defame or infringe the rights of any person or business, including the competitors you name
- Try to access accounts, data or systems you're not authorized to use, or interfere with the Services' security or performance
- Copy, resell, sublicense or provide the Services to others except as these Terms allow (for example, an agency serving its own clients where that feature is offered)
- Reverse engineer the Services, or use them to build a competing product
- Scrape, crawl or use automated tools to extract data from the Services
- Upload malware or content you don't have the right to share
We may suspend or remove content or accounts that violate these Terms.
9. Third-party services and public information
The Services rely on third-party providers (such as hosting, AI, payment and email providers) and collect publicly available information from websites and social media platforms. We're not responsible for third-party services or for the accuracy of public information. Your use of any third-party platform, such as a social network you publish to, is subject to that platform's terms.
10. Suspension and termination
You can stop using the Services and delete your account at any time. We may suspend or end your access if you violate these Terms, if your use creates risk or legal exposure for us or others, or if we stop offering the Services. If we end the Services for reasons other than your breach, we'll give reasonable notice where possible. After termination, your right to use the Services ends, and we'll handle your data as described in our Privacy Policy. Sections 5 through 7 and 11 through 16 survive termination.
11. Disclaimers
THE SERVICES AND OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, BRANDFUL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT OUTPUTS WILL BE ACCURATE OR ACHIEVE ANY RESULT.
12. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, BRANDFUL WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. BRANDFUL'S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES OR THESE TERMS WON'T EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100.
Some jurisdictions don't allow certain limitations, so some of these may not apply to you. Nothing in these Terms limits liability that can't be limited by law.
13. Indemnity
You agree to defend and indemnify Brandful and its officers, employees and agents against any claims, losses and expenses (including reasonable legal fees) arising from Your Content, your use of Outputs, or your violation of these Terms or the law.
14. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Services will be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you and Brandful consent to their jurisdiction. Before filing a claim, each party agrees to try to resolve the dispute informally by contacting the other for at least 30 days. If you're a consumer in the EU or UK, you also keep any rights you have under the mandatory laws of your country, including the right to bring proceedings in your local courts.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll notify you by email or in the Services at least 14 days before they take effect. If you keep using the Services after the changes take effect, you accept the updated Terms. If you don't agree, you can cancel before they take effect.
16. General
These Terms, together with our Privacy Policy, are the entire agreement between you and Brandful about the Services. If any part is found unenforceable, the rest stays in effect. Our failure to enforce a provision isn't a waiver. You can't transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control.
